The E-2 VISA CATEGORY

The E visa category is an extremely useful means by which individuals from certain privileged countries can remain in the United Sates for an indefinite period due to them having made an investment in a US based business. The E2 investors are permitted to remain in the United States for the entire period that the underlying investment remains in place.

Their spouses and children under the age of 21 are also permitted to remain in the US and attend school. Under recently approved law changes the spouse of the principal investor can also obtain work authorization during this period.

E2 status is available for those who wish to purchase an existing business and for those who wish to start-up anew business.

There is no restriction on the type of business that may be used. The business could be a convenience store or a car factory.

 Duration of stay

Normally an initial period of stay of two years is granted to persons coming to the United States in the E category however this period can be extended almost indefinitely as long as the underlying investment subsists and the E2 enterprise remains operational.

Application process

Unlike for most non-immigrant visas the application for E2 status is normally made through the U.S. Embassy or consulate in the applicant’s home country. It can also be made directly to the USCIS (immigration service) in the US although this is not usually advisable.
